ECOMFORM provides digital advertising and marketing services, including but not limited to:

Paid advertising management (Meta, Google, TikTok, LinkedIn)
Media buying
Marketing strategy
Lead generation campaigns
Consulting services
Creative development and campaign optimization

All services are provided on a contractual or agreed basis between ECOMFORM and the client.

3. Client Responsibilities

Clients agree to:

Provide accurate and complete information
Grant necessary access to advertising accounts and platforms
Approve materials in a timely manner
Comply with applicable laws and platform advertising policies
Pay agreed fees on time

ECOMFORM is not responsible for delays caused by the client’s failure to provide required materials or approvals.

4. Payments & Fees

All fees are agreed upon before services begin.

Payments must be made according to the agreed billing schedule.
Late payments may result in suspension of services.
Advertising budgets paid to third-party platforms are separate from BIYAFORM service fees.
All fees are non-refundable except as stated in our Return & Refund Policy.

5. No Guarantee of Results

While ECOMFORM applies industry best practices and data-driven strategies, we do not guarantee specific results such as:

Revenue levels
Sales volume
Lead quantity
Return on ad spend

Advertising performance depends on factors beyond our control, including market conditions, competition, audience behavior, and platform algorithm changes.

6. Intellectual Property

Unless otherwise agreed in writing:

Creative assets developed for the client become the client’s property upon full payment.
ECOMFORM retains the right to use non-confidential campaign results for portfolio or marketing purposes.
All proprietary tools, processes, and strategies remain the intellectual property of ECOMFORM.

7. Confidentiality

Both parties agree to maintain confidentiality of sensitive business information shared during the course of the working relationship.

Confidential information will not be disclosed to third parties unless required by law.

8. Limitation of Liability

To the fullest extent permitted by law, ECOMFORM shall not be liable for:

Indirect or consequential losses
Loss of profits or revenue
Platform account suspensions
Algorithm changes affecting performance
Third-party service interruptions

Total liability, if any, shall not exceed the amount paid to ECOMFORM for services during the preceding billing period.

9. Termination

Either party may terminate services with written notice according to the agreed service contract.

ECOMFORM reserves the right to suspend or terminate services if:

Payments are not made
The client violates advertising platform policies
The client engages in unlawful activity

10. Third-Party Platforms

ECOMFORM works with third-party platforms including Meta, Google, TikTok, and LinkedIn. We are not affiliated with or responsible for their:

Policy changes
Account suspensions
Service disruptions
Refund policies

Clients are subject to each platform’s terms and policies.

11. Governing Law

These Terms & Conditions shall be governed and interpreted in accordance with the applicable laws of the jurisdiction in which ECOMFORM operates.

12. Changes to Terms

ECOMFORM reserves the right to update or modify these Terms at any time. Updates will be posted on this page with a revised effective date.

Continued use of our services constitutes acceptance of the updated Terms.
